How Long Does An OPG Investigation Take?

How Long Does An OPG Investigation TakeWe understand that when someone is subject to an investigation by the Office of the Public Guardian because concerns have been raised about their actions as an Attorney, that this is an exceptionally stressful time.  How Long Does An OPG Investigation Take?

The first an Attorney hears is often the letter together with a 27-page form coming through the post, giving a two-week deadline to reply, and often a week of this has already passed by the time they receive the papers.

In the letter from the OPG, the investigator promises to complete the investigation as quickly as possible and says this will usually be within 14 weeks.

Whilst this is an aspiration of the OPG, we find that in many cases the OPG take considerably longer than this. Sometimes the next the Attorney hears is when the Court

Applications and Hearings office of the OPG write to the Attorney to say that they are making an application to the Court of Protection to initially suspend them and asking the Court of Protection to remove the Attorney and appoint an independent Panel Deputy to manage the Donor’s financial affairs.
